Non-Commercial Use by Members

The Jayakamala.com Site is for the personal use of individual members only, and may not be used in connection with any commercial endeavours unless registered and approved as an 'Affiliate' of the Site. This includes providing links to other websites, whether deemed competitive to Jayakamala.com or otherwise. Illegal and/or unauthorised uses of the Site, including unauthorised framing of or linking to the Site, will be investigated, and appropriate legal action will be taken, including, without limitation, civil, criminal, and injunctive redress.

Confidentiality

All communications between you and your Therapist/Practitioner/Coach/Counsellor/Jyotisha/Vedic Astrologer will be held in strict confidence unless you provide written/emailed permission to release information about your recommendations.

If you participate in a group consultation, Varun Rishi Uniyal or staff at Jayakamala.com will not disclose confidential information unless all person(s) who participated with you provide their written authorisation to release.

In addition, no one at Jayakamala.com will disclose information communicated privately to him or her by one family member to any other family member without written/emailed permission.

As a practice, we share pertinent history and recommendations with other health practitioners working with you when you have provided written/emailed permission. This will always be done in a confidential way, respecting your integrity and privacy.

We use third-party payment systems and do not collect or store any financial information.

All sessions are audio recorded and stored in MS Teams and/or Zoom cloud servers, which they maintain the compliance of. You acknowledge that the use of technology cannot always be completely secure and accept the risks to confidentiality in the use of email, text, phone, Teams, Zoom, and other technology.

Indemnity

You agree to indemnify and hold Jayakamala.com, its subsidiaries, directors, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of any of the terms of this Agreement and/or any breach of your representations and warranties set forth above.

Liability Waiver

You declare and represent that no promise, inducement or agreement not expressed in this agreement has been made. You hereby release, waive, and acquit your therapist/coach/Jyotisha, any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit action, demand or right to compensation for damages claimed or that you may have arising out of your own acts or omissions or acts and omissions of your Therapist/Coach/Jyotisha as a result of any advice given otherwise resulting from the therapeutic/coaching relationship contemplated by this agreement.

Moreover, in consideration of the benefits to be derived from the counseling, the receipt whereof is hereby acknowledged, you hereby indemnify and hold harmless, release, remise and forever discharge and covenant not to sue or hold legally liable Varun Rishi Uniyal or the staff at Jayakamala.com from any and all claims, demands, damages, actions, or causes of action whatsoever related to the counseling process.

You have read the above release and waiver of liability and fully understand its contents. You are aware that this is a waiver and release of potential liability and a contract between you and Varun Rishi Uniyal and the staff of Jayakamala.com.

You voluntarily agree to the terms and conditions stated above.

OTHER

By becoming a Member of the Site / Jayakamala.com Service, you agree to receive certain specific emails and SMS from Jayakamala.com. This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the Jayakamala.com service, contains the entire agreement between you and Jayakamala.com regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

You are under an obligation to report any misuse or abuse of the Site. If you notice any abuse or misuse of the Site or anything which is in violation of this Agreement, you shall forthwith report such violation to Jayakamala.com by writing to the email address under the Contact Us section. On receipt of such a complaint, Jayakamala.com may investigate such a complaint and, if necessary, may terminate the membership of the Member responsible for such violation, abuse or misuse without any refund of the subscription fee. Any false complaint made by a Member shall make such Member liable for termination of his / her membership without any refund of the subscription fee.

Jayakamala.com reserves the right to withdraw its services to any customer who is found to be unreasonable or abusive during their conversation with an astrologer, regardless of the reason. While Jayakamala.com will make every effort to resolve any such situation, in case this fails, such customers will be sent a written warning. If it is repeated, the said customer will not be permitted to transact on the platform. Any balance in the customer's wallet will be refunded, to the extent that a refund is possible.

Images: Some images used on the site have been taken from the internet or generated using AI, and if any of these belong to you, please let us know. Send us a notification, and we will promptly remove these after verification.

Product images may vary from the actual product, as some of these products are handcrafted and images are digitally enhanced for the web.

Refund Policy

Digital or Physical Goods & Reports or Readings

There are no refunds for digital purchases (e.g. eBooks, PDFs, pre-recorded workshops). For inquiries or problems, contact us.

Refunds cannot be issued on the order of any reports/readings under any circumstances, once the reading is done.

Customers are requested to order carefully and with full consideration. If you wish to cancel an order, please email info@jayakamala.com within 1 hour of making the payment. The timelines displayed on the site are approximate. We try to adhere to them to a very large extent. However, as some reports/readings are individual and manually generated by us, some delays are possible. We will try our best to deliver as soon as possible. Delays will not be considered as biases for refunds.

We do not consider refunds for incorrect data provided by the customer. We request you to please re-check all your data when entered. Jayakamala.com will not consider refund requests resulting from the incorrect data provided by you. However, if you email us at info@jayakamala.com within an hour of ordering the report/reading, we will consider the changes to be made.

No refunds will be issued on the return of physically damaged products. By ordering products on Jayakamala.com, the customer takes full responsibility for any damage caused to the product, post its delivery. In case such an order was made via the 'cash on delivery' mode of payment, the customer will be charged the cost of the product, as displayed on Jayakamala.com and the shipping/ customs/ courier charges or all three as applicable, if the product is returned.

The products and services offered by Jayakamala.com are not meant to replace any philosophical, emotional or medical treatment. It is offered here as a service. Jayakamala.com holds no responsibility or liability for the reality or reliability of the astrological effects on human physiology, by the gems represented and sold on the website. On ordering, the customer assumes full responsibility for this matter. Thus, no refunds will be issued on this ground.

Any damage caused to the product while in transit will be dealt with by Jayakamala.com and its agencies. While Jayakamala.com tries to make sure that the products displayed on the website are delivered to the customer in an as-is condition, the picture may differ slightly from the original product. The customers are advised to exercise discretion in this matter. No refunds will be issued on this bias.

Phone Advice: Please ensure that your contact number is in the full coverage area and that you answer the phone when it rings. Any call once connected will not be refunded.

Live readings: Please ensure that you are on time for the live reading. Jayakamala.com will not wait for more than 15 minutes for a scheduled reading, and after that, we may not be able to reschedule or refund. The discretion to reschedule or refund in such an event of missed live reading will totally lie with Jayakamala.com.

One-time classes and workshops

For single-session virtual events, refunds can be requested up to twenty-four (24) hours before the start date. A $10 processing fee will be charged. No refunds will be offered for any single-session events after the date of the event has passed. Refund requests based on non-attendance or unawareness of refund procedures will not be processed.
Multi-session class series and workshops

For multi-session class series, courses or workshops, full refunds will only be given if cancellation requests are received up to forty-eight (48) hours before the first session begins, minus a $20 cancellation fee.

After the start date, requests to cancel can be submitted up to one week (7 days) after the course or series has begun. Prorated refunds are only available within the first week of the series or course start date, and will be prorated minus the cost of the first session, as well as a $20 cancellation processing fee.

After the first week, only store credit will be provided. Refund requests based on non-attendance or unawareness of refund procedures will not be processed. A processing fee of $20 will be charged for each course cancellation that is processed.

In Person Workshops

For in-person events, refunds and cancellations are dependent on the course and will be listed on the registration form and/or info pages for the event.

All requests will be evaluated on a case-by-case basis.

Note: The no refund policy stands, and Jayakamala.com reserves the right to deny any refund or extension request as per the standard refund and cancellation policy as stated in this document.

Memberships & Subscriptions

Cancellations and Refunds

(a) Member may cancel access to the Membership at any time for any reason. Access to the Subscription and Site will be terminated at the end of the payment term. However, cancellation of the Membership and/or this Agreement by Member will not extinguish the Member’s obligation to pay the full subscription fee(s) as outlined in Section 2(a) if termination is requested after completion of the initial first seven (7) days. The member will remain obligated to pay all remaining unpaid subscription fees in full. If any Member requests termination of the Membership during the 1-month or 12-month term, the Member is not entitled to any full or partial refunds.

(b) Members may use the Site and Membership for lawful purposes only. You shall not post or transmit through the Site any material which violates or infringes the rights of others, or which is racist, unethical, threatening, abusive, defamatory, libelous, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, contains injurious formulas, recipes, or instructions, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law. Doing so is grounds for termination of service, at our discretion.

In the event that Member engages in abusive or otherwise unprofessional behaviour as outlined above in the community forum or Site, towards representatives of Company or other members, Company reserves the right to cancel Member’s Membership and terminate access to the Membership, without warning. No refund will be provided in the event that this takes place. The member will remain obligated to pay all remaining unpaid membership fees in full.

Member agrees to communicate with other members with the utmost respect and professionalism.

(c) Member’s failure to effectively participate in the Membership is not grounds for a refund.

(d) Programming. Times and dates for monthly programming are pre-scheduled and will be shared with Members via e-mail/SMS/Social messaging services. In the event that a live call or training needs to be rescheduled, Jayakamala.com will notify Members via email at the earliest possible time. In the event that a training session is cancelled, Jayakamala.com will make an effort to arrange alternative programming, but does not guarantee that it will be able to do so. Cancellation or rescheduling of programming is not grounds for a refund, full or partial.

(e) Refund Policy. Due to the nature of the membership services provided, no refunds can be provided after the first seven (7) days of membership. Member understands that disputing a charge through his or her financial institution is a violation of this Agreement and agrees not to do so. Please refer to Section 2(c) for our payment dispute policy.

(f) The Membership and Term cannot be paused or placed on hold for any reason without the written authorisation of Jayakamala.com.
